The Effectiveness of National Fora in Europe for the Practice of Antitrust Litigation

This article includes a comparative analysis of the different approachs used by courts in calculating antitrust related damages in Germany, England and Wales and the Netherlands. The analysis encompasses such things as overcharge and passing-on, and the fee structures available in each jurisdiction whether conditional/contingent, etc. The availability of collective actions and the chances of standalone actions are also examined.
